A consumer is any natural person who enters into a legal transaction for purposes which predominantly cannot be attributed either to their commercial activity or to their self-employed professional activity.

Right of withdrawal

Insofar as, as a consumer, you are legally entitled to a right of withdrawal in the case of a distance contract, you have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods or of the last goods.

by means of a clear declaration, for example by a letter sent by post or by e-mail, of your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments we have received from you, including delivery costs, without undue delay and in any event not later than fourteen days from the day on which we received the communication of your withdrawal from this contract.

For this reimbursement, we shall use the same means of payment that you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earlier.

You shall send back or hand over the goods to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You shall bear the direct cost of returning the goods. In the case of goods which, by their nature, cannot normally be returned by post, these return costs may be considerable depending on size, weight and transport effort.

You are only liable for any diminished value of the goods if this diminished value results from handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or non-existence of the right of withdrawal

The right of withdrawal does not exist in contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.

This may apply in particular to individually configured or custom-made chicken coops. Whether a right of withdrawal is excluded in the individual case depends on the specific nature of the ordered goods and their degree of personalization.
